Ladder ban list?

I just played a game on the ladder and I fought a Garchomp. Last time I checked, they were banned on the ladder, so how did this person use one? Does the ban list not prevent them from using the pokemon or something?

And finally, what do I do when I'm facing a banned pokemon if I have no chance against it?

You accidentally selected a ladder to play on that you didn't mean to, such as the Suspect or Ubers ladder, both of which allow Garchomp. The program will not allow you to use a banned pokemon on a ladder where it is actually banned. If you encounter a generally banned pokemon in a friendly, just leave if you don't want to fight it; it is a friendly, after all. Post in the Simple Questions thread next time.
